Dog killer receives two years in prison

An Elgin man will serve a prison term for killing his roommate’s Chihuahua during an argument between the two men earlier this year.
Oscar Guerrero, 20, of the 500 block of Lavoie Avenue, accepted a plea agreement Wednesday with the Kane County State’s Attorney’s Office to a sentence of two years in the Illinois Department of Corrections in exchange for a guilty plea to one count of aggravated cruelty to animals, a Class 4 felony.
Associate Judge James C. Hallock accepted the plea.
According to police and prosecutors, at about 1:30 a.m. May 13, Guerrero, who had been drinking alcoholic beverages, awoke a roommate and asked him to help with a project. The roommate, who had been sleeping with a Chihuahua named Daisy on the sofa in the living room, refused. The two men began to argue and then Guerrero grabbed Daisy by the scruff of the neck and threw her at a wall, killing her.
According to Illinois law, Guerrero is eligible for day-for-day sentencing. Guerrero was given credit for at least 137 days in the Kane County jail, where he had been held since his arrest in lieu of $50,000.
The case was prosecuted by Kane County Assistant State’s Attorney Deborah Lang.
